1. Agreement to Terms

By accessing or using FounderX ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Eligibility

To use FounderX, you must:

  • Be at least 18 years of age
  • Be a founder, co-founder, or key decision-maker at a company
  • Provide accurate and complete profile information
  • Verify your identity through LinkedIn or other approved methods
  • Maintain the security of your account credentials

3. Membership and Subscription

FounderX offers a subscription-based membership:

  • Subscriptions are billed monthly on a recurring basis
  • You may cancel your subscription at any time through the app
  • Cancellation takes effect at the end of the current billing period
  • Refunds are not provided for partial months
  • We reserve the right to modify pricing with 30 days notice

4. Community Guidelines

As a member of FounderX, you agree to:

  • Be Reliable: Honor your commitments to attend scheduled sessions. Repeated no-shows may result in account restrictions.
  • Be Respectful: Treat all members with respect and professionalism. Harassment, discrimination, or inappropriate behavior will not be tolerated.
  • Be Authentic: Provide accurate information about yourself and your company. Misrepresentation may result in account termination.
  • Be Engaged: Participate actively in Circle activities and contribute positively to the community.

5. Reliability Score

Your reliability score is calculated based on attendance, RSVP accuracy, peer ratings, and participation. Low reliability scores may result in reduced matching priority or temporary suspension from the platform. We believe in maintaining a community of committed individuals who respect each other's time.

6. User Content

You retain ownership of content you submit to FounderX. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service. You agree not to post content that:

  • Is illegal, harmful, threatening, or discriminatory
  • Infringes on intellectual property rights
  • Contains spam, advertising, or promotional material
  • Violates the privacy of others
  • Is false, misleading, or deceptive

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FounderX and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

8. Privacy

Your use of FounderX is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

9. Assumption of Risk

Participation in sports activities carries inherent risks. You acknowledge and accept these risks when participating in FounderX sessions. We recommend appropriate warm-up, proper equipment, and awareness of your physical limitations. FounderX is not responsible for injuries sustained during sessions.

10. Limitation of Liability

To the maximum extent permitted by law, FounderX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee the quality, accuracy, or reliability of content or matches made through the Service.

12. Account Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Harassment or abuse of other members
  • Extended inactivity (12+ months)
  • Any other conduct we deem harmful to the community

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Malaysia.
